The short version
- · You can submit a podcast feed only if you own it or have permission.
- · Your content stays yours; we get a licence to display it.
- · No impersonation — including claiming guest profiles that aren't you.
- · The service is currently free; if that changes, you'll see the price before you pay.
- · We may suspend accounts that breach these Terms.
1. Agreement
These Terms govern your use of PodSocial.fm (the “Service”), provided by Story Ninety-Four (“we”, “us”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms work alongside our Privacy Policy, which explains how we handle personal data.
2. Eligibility & account
You must be at least 13 years old to use the Service. You are responsible for keeping your account credentials secure. We use Clerk for authentication; their terms also apply to your sign-in.
One person, one account. Account sharing is not permitted.
3. Your content and our licence
Your content stays yours. You retain all rights in the podcast feeds, episodes, artwork, transcripts, photos, bios, and any other content you submit or that we ingest from a feed you submit.
By using the Service, you grant us a non-exclusive, worldwide, royalty-free licence to host, cache, render, and serve that content as required to operate PodSocial. The licence is limited to what is reasonably necessary to display your content on the platform; we do not use it for advertising or sub-license it to third parties beyond the subprocessors disclosed in our Privacy Policy.
You warrant that you own or have the rights to the content you submit, and that publishing it on PodSocial does not infringe any third party's rights.
4. Acceptable use
You may not use the Service to:
- Submit a podcast feed you do not own or have explicit permission to publish on a third-party platform.
- Impersonate a guest, podcast owner, or any other person — including by claiming a guest profile that isn't you.
- Publish content that is unlawful, defamatory, harassing, hateful, or that infringes intellectual property or privacy rights.
- Submit content that is sexually explicit involving minors, advocates violence, or facilitates serious criminal activity.
- Attempt to access another user's account, the underlying systems, or any non-public part of the Service.
- Scrape, mass-download, or otherwise extract data from the Service in volumes inconsistent with normal use. Public RSS feeds are still RSS — go to the source.
- Send unsolicited bulk email to other users via any feature of the Service.
5. Podcast claims
Claiming a podcast requires demonstrating ownership of the email address listed in the feed's <itunes:owner> tag (or an equivalent verification path we may add). A verified claim grants you control over the podcast's page on PodSocial — colours, social links, platform buttons, and the ability to opt the show into the guest directory.
Submitting a feed you do not own, even if not yet claimed, is a breach of these Terms and may result in suspension or removal.
6. Guest profiles
If a podcast feed credits you as a guest with a recognisable per-person URL (LinkedIn, Twitter, Bluesky, etc.), a guest profile may be auto-generated for you. You can claim that profile via the “Is this you? Claim this profile” button. Approval is by an admin or by the owner of a podcast on which you appear.
Once claimed, you are responsible for the bio, links, and tags you set. Misrepresentation, impersonation, or content that breaches Section 4 may result in revocation of the claim.
If you do not want a public profile and your name appears in someone's feed, contact us at hello@storyninetyfour.com and we will suppress the profile.
7. Suspension and termination
We may suspend or terminate your account, with or without notice, if you breach these Terms. We may also delete content that is unlawful or that materially harms other users.
You can stop using the Service at any time. To delete your account, see “Your rights” in the Privacy Policy.
8. Service availability and changes
We try to keep the Service available and reliable but do not guarantee uninterrupted access. We may add, remove, or change features at any time. Material changes that adversely affect existing users will be communicated by email where reasonable.
The Service is currently free to use. If we add paid plans, the relevant terms will be added to these Terms and prospective customers will see them at point of sale.
9. Disclaimers and liability
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all implied warranties.
We do not endorse, verify, or take responsibility for the content of any podcast feed we host. Listening to a podcast through PodSocial routes you to the publisher's media via their RSS feed; the publisher is the source of truth for that content.
Nothing in these Terms limits or excludes our liability for: death or personal injury caused by negligence; fraud; or any liability that cannot be excluded under applicable law. Subject to that, our aggregate liability in any 12-month period is limited to the amount you have paid us in that period (currently zero, as the Service is free).
10. Governing law
These Terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute relating to these Terms, except that consumers may have additional rights under their local law.
11. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent material change. For any change that materially affects your rights, we will email account holders before the change takes effect.
